In a closely watched court case, U.S. District Judge Rosemary M. Collyer will soon decide whether to order discovery to compel U.S. Citizenship and Immigration Services (USCIS) to reveal why it has enacted new restrictive immigration policies on companies that employ H-1B visa holders. One of the allegations made by the plaintiffs in the ITServe Alliance v. USCIS lawsuit is that USCIS intentionally drives up the costs of filing for H-1B petitions, including by issuing approvals that last for as little as one day.

Since 2017, as part of its efforts to “hire American,” the Trump administration has been aggressively denying applications for H-1B visas. Yet a record number of those denials have been overturned on appeal, suggesting that the administration has been wrongfully rejecting qualified applicants for these coveted visas for high-skilled immigrants.
