odmowa wydania wizy

Konsul odmówi3 mi wydania wizy podając strasznie metne wyt3umaczenie. Zanim cokolwiek zdecydowa3, 4 razy chodzi3 na narade z pozosta3ym konsulami. Nastepnie poinformowa3 mnie, ?e nie wyda mi wizy, poniewa? za pó3 roku koncze szko3e (szko3e średnią; ?e za szybko i przypadkiem móg3bym iśa do pracy). Czy moge wnieśa odwo3anie od tej decyzji? Jeśli tak to w jaki sposób i do kogo?

nie ma juz koncepcji odwolania - moze jedynie sie np pracodawca za toba wstawic i przedzwonic do ambasady ale to tez nic nie gwarantuje..

Jezeli masz jakas rodzine lub znajomych w USraju i sa oni obywatelami to moga oni interweniowac pod adresem :

W 99% taki e-mail nie zmieni decyzji konsula ale ten 1% zawsze isnieje :)

Moze przynajmniej podadza jakies sensowne wyjasnienie.

Following an interview with a consular officer,

they were found ineligible under Section 214(b) of the Immigration and

Nationality Act (INA).  This section of law states that every alien

shall be presumed to be an immigrant until he or she establishes to

the satisfaction of the consular officer that he or she is entitled to

nonimmigrant status.  Section 291 of the INA places the burden of

proof of the entitlement to nonimmigrant status on the applicant. 

Applicants for student, business or tourist visas must convince the

interviewing consular officer that they plan to travel to the U.S.

solely for those purposes, and that they have permanent residences

abroad which they do not intend to abandon. To satisfy these

requirements, applicants are asked to present evidence of family,

employment, economic or other ties to their homes abroad that would

compel them to return. ...



Please do not feel that the denial of a nonimmigrant visa is in any

way based upon the situation of the inviting party.  As previously

indicated, given the information presented by the applicant at the

time of the visa interview, xxxx were simply unable to prove to the interviewing officer that they were either not intending immigrants, or, equally common, that their purpose of travel was legitimate.  In addition, there is currently no provision within the law that allows for a U.S. citizen

or resident to guarantee the departure of a nonimmigrant visa holder

from the U.S.



We realize a visa refusal is disappointing.  Nonimmigrant visa

refusals under Section 214(b) INA are not permanent.  We generally

recommend that applicants wait until they have a significant change in

their life situation and we normally expect that applicants wait at

least one year before reapplying for a nonimmigrant visa.  Applicants,

however, may reapply for a visa at any time.



Should applicants wish to reapply, they should call the following

telephone number to schedule an appointment: 0701 77 44 00. 

Applicants should have passports, pen and paper available when they

call.  This service is available from 7:00 a.m. to 8:00 p.m. Polish

time Monday through Friday. Service is available in both English and

Polish, and includes information on types of visas and necessary

documents.  Please note that callers must be in Poland to call this

number, and that calls cannot be made from public telephones or

cellular phones.  Information about our procedures and documentary

requirements may also be found at our website at  www.usinfo.pl



We must stress, however, that there is no guarantee that a new

appointment will result in the issuance of a visa, particularly if the

applicant's personal circumstances remain essentially unchanged.

Za malo mamy danych o Tobie!

Czy jestes w takim razie prezesem swietnie prosperujacej firmy (i wtedy raczej otrzymasz wize np. turystyczna lub biznesowa)? Czy tez wrecz odwrotnie - nie uczysz sie, nie pracujesz, nic Cie z Polska nie trzyma (wowczas szanse sa... :cry: )?

Wiekszosc programów (Work&Travel, Camp, Internship, PCT*) dotyczy wlasnie studentów i uczniów, czyli w Twoim przypadku chyba nic z tego... :twisted:

Pozostawalby (byc moze...) wyjazd w oparciu o wize H2B, ale... zbyt malo wiemy o Tobie!

P.S. * - mozna wyjezdzac tez na tego typu programy, bedac absolwentem, choc kazdy rok po ukonczeniu nauki chyba zmniejsza takie szanse (wiem, wiem, na PCT mozna teoretycznie do 40. roku zycia!)... :lol:
