Wlasnie rozmawialam z tesciowa. Mowila, ze pani na lotnisku w Dublinie wlozyla jej karte do maszynki i zadawala jej pytania, na lotnisku JFK juz nic nie robili. Czy ta pani w Dublinie ma juz jakis wplyw na reszte?

Decyzja na ta chwile jest taka...ja lece, ryzykujac, jesli stwierdza cos nie tak, zrzekam sie gc. Ale nie biore takiej wersji pod uwage, jesli mnie wpuszcza tesciowa od razu zaklada papiery na mojego narzeczonego i naszego syna. Przepisy sie zmieniaja, i tutaj musisz patrzec na kilka ostatnich lat, a w zasadzie ty bedzie dopiero tworzyc historie. Resident status is considered to have been taken away from you if the U.S. government issues you a final administrative or judicial order of exclusion or deportation. A final judicial order is an order that you may no longer appeal to a higher court of competent jurisdiction.

Resident status abandoned

An administrative or judicial determination of abandonment of resident status may be initiated by you, the USCIS, or a U.S. consular officer.

I'm a Green Card holder. I entered US in January in 2009 and was questioned separately in a room by an officer on my short stays over the past 5 years in US. ANSWER:

You have a big problem. A Residency status is for someone that resides in the U.S. So yes, it is very possible that you will have your green card taken away, but they will parole you into the U.S. and you will have to go eventually before an immigration judge and explain why you should not have your status cancelled and be deported from the U.S. You will need to prove that you have not intended to abandon your Residency status. You would do that by showing proof of paying your U.S. taxes while you have been away, maintaining a U.S. home, paying U.S. bills, etc. etc.

Hi, I would like to know what happens if a green card is taken away

upon entering the US because the immigration check believes that the

holder (EU national) has abandoned his/her permanent resident status.

In particular:

1. Is it correct that the holder can choose between a) voluntarily

surrender the GC immediately or :) go to court?

2. If the above is correct and the holder surrenders the GC, will the

holder be able to remain in the US on a tourist visa?

leave the country until the court appearance? How long is the wait

Anyone who claims to be a US permanent resident has the *right* to a hearing before an immigration judge who will make the final determination of whether or not the PR status has been abandoned. By itself, time spent outside the US is usually not sufficient to demonstrate that PR status has been abandoned; there must also be an intent to abandon status. References? It's in the INA.

is whether one required not to leave the country until the hearing,

and how long does it usually take between the moment the GC is taken

away and the hearing.

The judges have appointment backlogs too so the hearing wait could vary

depending on various factors. It could be as short as a few days to as long

as more than six months. During those days you are waiting for an IJ hearing

you could possibly be staying in an immigration detention facility!

Are you serious? I imagine the holder can decide to give up the GC

voluntarily at which point no hearing

will be necessary. And even if a hearing is scheduled, why should one

It depends on whether you want to keep your PR status or not. If you want to surrender your GC and give up your PR status, you can do that voluntarily without any court visits.

If you're trying to keep your PR status, and the authorities are trying to take it away, that's when you will be detained, so you will have a chance to plead your case before an immigration judge.

When you phrase it as "green card taken away", it sounds like you want to keep it, but they are taking it away. If you yourself want to give it up voluntarily, there's no problem.

A permanent resident may abandon status at any American Consulate overseas. The Consulate will cancel and take away the person’s green card. A former permanent resident will generally need a new nonimmigrant visa to reenter the US. He or she will need a US immigration work permit or working visa to receive earned income from a US source while physically present in the US, even if the presence in the US is unrelated to business. A former permanent resident who remains on a US payroll will not need a US work permit or working visa if he or she does not enter the US.

A permanent resident may have such status taken away through an administrative civil proceeding called a Removal Hearing. A Removal Hearing will be scheduled for a permanent resident who has been absent for such a long period that the CIS officer at the port of entry deems that he or she has abandoned status. In a Removal Hearing, an Immigration Judge will consider all the facts in the case and render a decision to either admit the person as a permanent resident, or order the former permanent resident be removed from the US at government expense. A person who has been removed from the US at government expense may not reenter the US for five years.

If a permanent resident is in jeopardy of losing permanent resident status due to long absences, he or she should consider abandoning such status at a Consulate, rather than risk having such status taken away in Removal Proceedings
